1. Agreement to Terms

By accessing or using ReportCardPilot, available at reportcardpilot.com, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ReportCardPilot is an AI-powered report card generation tool designed for K-12 educators. The Service allows teachers to:

• Create and manage classes and student rosters
• Input student assessments, grades, and observations
• Upload lesson plans (text, PDF, or image)
• Upload past report cards for writing style matching
• Generate AI-written report card comments
• Download completed report cards in PDF and Word formats
• Use the Service in English and French

3. Eligibility

You must be at least 18 years of age and a legal resident of Canada or the United States to use this Service.

4. Account Registration

To use the Service, you must create an account by providing your name, email address, and a password. You agree to provide accurate information, maintain the security of your credentials, notify us of unauthorized use, and accept responsibility for all activity under your account.

5. Acceptable Use

You agree to use the Service only for its intended purpose — generating report cards for students you are authorized to evaluate. You agree NOT to:

• Use the Service for any unlawful purpose
• Upload false, misleading, or fabricated student data
• Attempt to reverse-engineer, decompile, or extract the AI models, prompts, algorithms, or proprietary methods used by the Service
• Scrape, crawl, or use automated tools to extract data or content from the Service
• Resell, sublicense, or redistribute the Service or its output without our written consent
• Interfere with or disrupt the Service's infrastructure
• Share your account credentials with others
• Use the Service to generate content for purposes other than educational report cards

6. Student Data and Your Responsibilities

You acknowledge that you are the data controller for any student information you input into the Service. You represent that you have the necessary authorization from your school or institution to use an AI-powered tool for report card generation, and that you are compliant with all applicable education privacy laws including FERPA (US) and PIPEDA (Canada).

We are a service provider/processor. We process student data solely on your behalf and according to your instructions. We do not sell, share, or use student data for any purpose other than providing the Service to you.

7. AI-Generated Content

The Service uses Anthropic's Claude AI to generate report card comments. Student data you input (including names, assessments, and observations) is transmitted to Anthropic's servers for processing.

• AI-generated content is a draft and a starting point — you are responsible for reviewing, editing, and approving all content before use
• We do not guarantee the accuracy, completeness, or appropriateness of AI-generated comments
• You are solely responsible for the final report cards you distribute to students, parents, or your institution
• AI-generated content does not constitute professional, educational, or legal advice

8. Pricing and Payment

Pricing is displayed on our website and may change at any time with 30 days' notice to existing users. A free trial may be available. Payments are processed securely through Stripe. We do not store your credit card information on our servers. All fees are non-refundable unless required by applicable law.

9. Intellectual Property

The Service, including its design, AI prompts, algorithms, software, and branding, is owned by ReportCardPilot and protected by copyright and other applicable intellectual property laws.

You retain ownership of all content you upload to the Service. By uploading content, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the Service to you. This license terminates when you delete your account.

You own the report card comments generated by the Service for your use. We retain the right to use anonymized, aggregated data (with no personally identifiable information) to improve the Service.

10. Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind. We are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim. We are not responsible for any consequences arising from your use of AI-generated content in official report cards.

11. Termination

You may terminate your account at any time through your account settings. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be permanently deleted in accordance with our Privacy Policy.

12. Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada. Any disputes shall be resolved in the courts of the Province of Ontario, Canada.
